Welcome to the website www.referralrecruitment.com and its service(s) (the "Site") operated by Referralrecruitment, a company registered in The Netherlands (Europe) which has its registered office at Groenhoedenveem 101, 1019 HM Amsterdam.
Referralrecruitment offers a global online social recruitment Site which facilitates a job referral reward service (the "Service(s)") for individuals or organizations seeking employees and offering a Referral Reward ("Recruiters"), individuals or organizations seeking to help others finding employees (and employment) and receiving a Referral Reward ("Referrers"), and individuals seeking employment ("Candidates").

PLEASE READ THE TERMS AND CONDITIONS AGREEMENT (THE "TERMS AND CONDITIONS") CAREFULLY BEFORE USING THE SITE. BY USING THE SITE, WHETHER OR NOT YOU REGISTER AS A USER, YOU AGREE TO BE BOUND BY THE TERMS AND CONDITIONS, AS AMENDED BY REFERRALRECRUITMENT FROM TIME TO TIME. IF YOU DO NOT AGREE, PLEASE DO NOT USE OUR SITE.

General

The Terms And Conditions explains the rules by which individuals must agree to abide by in order to use our Site. In case you violate the Terms And Conditions, Referralecruitment has the right to deactivate or cancel your access to the Site.

When we refer to "You" and "Your(s)" we mean the user of the Site whether or not the person uses the Service offered through the Site. When we refer to "We", "Our(s)", "Us" we mean Referralrecruitment.

All documents and communications between us will be in English, unless agreed otherwise.

The Terms And Conditions do govern the disclaimer statement (the "Disclaimer") and the privacy policy (the "Privacy Policy") (and any other condition specifically agreed between us) and do set out the entire Agreement between you and Referralrecruitment in respect of the use of the Site.

Eligibility

You must be eighteen or over to register as a user (member) of Referralrecruitment to use the Site. By using the Site, you represent and warrant that you have the right, authority and capacity to enter and abide by the Terms And Conditions. Registration (membership) of Referralrecruitment is void where prohibited.

Registration (User) Account And Password

A visitor of the Site does not have to register to browse the Site and to access the job postings on its Public Job Board.

To be able to post jobs with Referral Rewards, to refer jobs to others, to monitor the status of job postings with its referral paths to Candidates, to receive applications and resumes of applicants, and to recruit future employee(s) you are required to register and to login on the Site as a user type Recruiter (hirer) on behalf of a company (organization).

A Recruiter is a corporate recruiter (at an organization) or a professional third party recruiter (at a recruitment agency, acting on behalf of clients) to hire job Candidates.
If it is the first time registration (subscription) it may be you will be contacted. The Recruiter can only register one company in a single registration.

The Referral Reward is a bonus or bounty offered by the Recruiter in the job posting, to the Referrer(s) for the successful referral (recommendation) of a hired Candidate (hire), all through the Site. A successful referral is defined as where a Candidate, who is referred by the Referrer(s) for a position, is hired by the Recruiter for a position and remains employed in that position for at least 60 days.

In case the Recruiter did get directed to the Site for registration (subscription) by an Affiliate, which is a person or organization who is engaged (appointed) by us for the purpose of directing (inviting) Recruiters for registration to the Site, the Recruiter must fill in upon registration the field "How did you hear about Referralrecruitment?" and selecting "Affiliate" and filling in the field "Name" the full name and the e-mail address of this Affiliate in order to compensate this Affiliate by Referralrecruitment for his/her/its successful marketing efforts.
To be able to refer jobs to others, to express interest in a job and to apply to a job, to monitor the status of referrals and applications, you are required to register and to login on the Site as a user type Referrer/Candidate acting as a Referrer and/or Candidate.
A Referrer is a private person (employee, family, friend, acquaintance, or others) or a professional third party recruiter (at a recruitment agency, acting on behalf of clients) making a referral of (recommending/placing) a Candidate to a Recruiter through the Site and gets a Referral Reward when this Candidate is hired by the Recruiter.
A Candidate is a private person (job seeker) who expresses interest in a job and is typically referred (recommended/placed) by a Referrer for a job which is posted by a Recruiter, all through the Site.

If you register an (user) account ("Profile"), which is a body of personal information within the Site and only viewable and accessible by the registered user (member) himself/herself of the Site when logged in, you represent that you are at least 18 years old and that, to the best of your knowledge and belief, your registration information is truthful, accurate and complete. Please note that all details in the registration like your full name must be bona fide as these are required when doing financial transactions.
A user name (e-mail id) and password will be chosen by you; if you forgot your password, a (temporary) password may be assigned by us. You are solely responsible for maintaining the secrecy of your information and password and for all activities occurring under your account. Be sure to change your password promptly and notify us if you believe your account is lost, stolen, or being unauthorized accessed by others. You may not loan your user name and password to others. Each user must register separately.
Currently it is only possible to have one registered e-mail address per user account.

Under no condition can Referralrecruitment be held liable for possible technical problems and/or shortcomings in the mentioned Profile and/or logo (in case of a Recruiter's company).
You agree that Referralrecruitment, in its sole discretion, at any time, has the right to deactivate or cancel the registration (membership), remove or delete your (user) account (or any part thereof), remove and discard any content on the Site and to exclude the user for current and future use of the Site, for any reason or no reason, with or without prior notice, including, without limitation, for lack of use, in case user provides information which is not true, up-to-date or complete, or in case Referralrecruitment has a reasonable presumption that provided information is not correct or user is violating guidelines, violating the Terms And Conditions, or engaging in shenanigans, or acted inconsistently with the letter or spirit of the Terms And Conditions.
Further, you agree that Referralrecruitment shall not be liable to you or any third party for any cancellation of your access to the Site and use of the Service. Referralrecruitment cannot be held liable for any loss or damage resulting from the fact that the user failed to respect these provisions and cancellation of the membership.

You can terminate your user account at any time in My Profile or you may contact us via the Contact Us page. Note: only change user status to "terminated" if you do not use your registration anymore as you will not be able to login anymore. Even after the registration is deactivated or cancelled, the Terms And Conditions will remain in effect.
When all obligations have been met your user account and all of its content will be subsequently deleted.
However, Referralrecruitment may retain a copy in its files, even if deleted, in order to resolve any pending actions, disputes or enforce the Terms And Conditions.

Referralrecruitment agrees to use your information in accordance with Referralrecruitment's Privacy Policy applicable to personally identifiable information.

User Conduct

By tick marking the "I have read and accept the Terms and Conditions" tick mark box on the "Registration" web page or by logging in to the Site you accept the Terms And Conditions and agree that:

  • The Site may only be used for lawful purposes. Transmission or solicitation of any material that violates Dutch law and/or other laws, rules or regulations that may apply in the jurisdiction of your local, state, federal or international area, is prohibited.
  • You are prohibited from taking any action that violates, or attempts to violate, the security and access control provisions of the Site and/or networks used to provide the Site.
  • Your use of the Site is subject to the Prohibited Content and Commerce Statement, which outlines the most common rules about activities that are not acceptable when using the Service and prohibits the use of the Site by any person, company or site that engages in any of the following:
    • Introduces viruses, worms, harmful code and/or Trojan horses on the internet or any other program or code intended to disrupt or disable the operations of the Site.
    • Provides, sells or offers to sell the following products or content (or services related to the same): pornography, nudity, online gambling, escort services, illegal goods, illegal drugs, illegal drug contraband, pirated computer programs, instructions on how to assemble or otherwise make bombs, grenades or other weapons.
    • Displays material that exploits children, or otherwise exploits children under 18 years of age.
    • Posts or discloses any personally identifying information or private information about children without their consent (or their parent's consent in case of a minor).
    • Provides material that is grossly offensive, including blatant expressions of bigotry, prejudice, racism, hatred or excessive profanity or posts any obscene, lewd, lascivious, filthy, excessively violent, harassing or otherwise objectionable content.
    • Engages in any libelous, defamatory, scandalous, threatening, harassing activity.
    • Posts any content that advocates, promotes or otherwise encourages violence against any governments, organizations, groups or individuals or which provides instruction, information or assistance in causing or carrying out such violence.
    • Provides, sells, or offers to sell or rent any e-mailing list.
    • Sells or promotes any products or services that are unlawful in the location at which the content is posted or received; sending unsolicited commercial mass or bulk e-mail (spam).
    • Promotes, solicits or participates in pyramid schemes, multi-level marketing, chain letters.
    • Engages in a phishing scam or otherwise intends to mislead users by improperly using recognized trademarks or designs.
  • You will not use our Site for any other purposes than those intended with the Service to identify prospective employees for your employment opportunities, those persons to whom you are permitted to send and/or share job postings, or to identify employment opportunities for yourself in accordance with the Terms And Conditions.
  • You will not submit large numbers of postings, referrals or content that disrupts communication on the Site and/or imposes an unreasonable or disproportionately large burden of the Site's infrastructure.
  • You will not falsely state, impersonate, or misrepresent your identity.
  • You will not upload, post, e-mail or share content or images that infringes upon patents, trademarks, copyrights or other proprietary rights.
  • You will not automatically download data from the website via spiders, crawlers, robots or other data mining tools without Referralrecruitment's consent or without complying with our robots.txt file.
  • You will not include any hyperlinks, other than Referralrecruitment's hyperlinks, or any misleading, irrelevant and/or hidden keywords in any content on the Site such as job postings, referral e-mail messages.
  • All Referralrecruitment's e-mails will automatically receive an identifying mark stating "Referralrecruitment" such as the name in the e-mail address "info@referralrecruitment.com", body/footer text "powered by Referralrecruitment.com" or a similar text.
  • You are responsible for ensuring your referral e-mail message campaigns do not generate a number of abuse complaints in excess of industry norms.
  • The foregoing list of prohibitions provides examples and is not complete or exclusive.
    Referralrecruitment, at is sole discretion, may immediately disable your access to the Site if it believes that you have violated any of the terms above.

    You hereby acknowledge and agree that you may be exposed to conduct and/or content that may be offensive or objectionable to you. Your access to the Site is undertaken at your own risk, and Referralrecruitment is not responsible for any offensive or otherwise objectionable conduct by any third party and/or content that may be submitted by any third party.
    Users do not have access to each other.
    Referralrecruitment may report to law enforcement authorities any actions that may be illegal, and any reports it receives of such conduct. When legally required or at Referralrecruitment's discretion, Referralrecruitment will cooperate with law enforcement agencies in any investigation of alleged illegal activity on the Site.

    Use Of Site And Content

    You will ensure that your use of our Site is fair, reasonable and not excessive. Referralrecruitment has the sole discretion to determine whether your use of our Site if unfair, unreasonable and/or excessive.

    Referralrecruitment can be used privately or as well publicly (optional). Job postings in Referralrecruitment can be kept private on your own Private Job Board (internal, by invitation only) like a "closed" system; these positions may be 'sensitive' searches, very geographically restricted or just a desire by the Recruiter to limit the number of Referrers and/or be selective in the group of people to invite as Referrers (e.g. a peer group). It is optional to make the job postings also public on the Public Job Board (external, visible to anyone) on the Referralrecruitment website like an "open" system.

    Referralrecruitment is international. Although the default language (of the use) of the application is English, job descriptions and referral e-mail messages can be customized/personalized to the preferred language of the users.

    Referralrecruitment makes no claims that the content of the Site may be lawfully viewed or downloaded with the laws of your jurisdiction. Access to the content of the Site may not be legal to certain persons or in certain countries. If you access the Site, you do so at your own risk and are responsible for compliance with the laws of your jurisdiction.
    The Site acts only as a venue for Recruiters to post job listings with a Referral Reward, Referrers to recommend Candidates and to earn Referral Rewards, and Candidates who send applications and resumes directly to Recruiters.
    Referralrecruitment is not involved in the actual posting, referral, hiring and rejection processes and activities between Recruiters, Referrers and Candidates. As a result, Referralrecruitment has no control over the quality, safety or legality of these processes and activities.
    The user is solely responsible for the content submitted to the Site, including its legality, reliability, form and accuracy, and the use of the Site, including without limitation, the consequences of all job postings, referral e-mail messages or other e-mail messages, applications, resumes, files, images, or other materials that you post on, send, transmit through, link to the Site.

    Referrralrecruitment does not, and cannot, screen or censor all content on the Site and all communications through the Site and is therefore not required to monitor, police or remove content submitted by you or any other user. The data submitted to a user account remain the property of the user.
    You understand and agree that Referralrecruitment has the right (but not the obligation) to pre-screen, refuse, suspend (temporarily or perpetually), (re)move, delete the display of any content for any other reason, including but not limited to violating guidelines, violating to the Terms And Conditions or inappropriateness.
    You acknowledge that any reliance on material posted by other users will be at your own risk.
    Referralrecruitment does not represent or guarantee the truthfulness, accuracy or reliability of any content posted by users or endorse any opinions expressed by users.

    Referralrecruitment provides alert mechanisms to help make sure everyone is treated fairly such as "flagging" intended to encourage Recruiters to pay the Referral Reward and the Referral Success Fee in case that a Candidate is hired if the Recruiter hires, satisfactorily completes a business arrangement with, transacts with or successfully utilizes the Candidate that applied to the job posting with the Referral Reward through Referralrecruitment.
    Referrers and Candidates must alert/bring to the attention through flagging in the system if the Candidate statuses are not up-to-date reflected on the Site. Referrer(s) need(s) to flag reward (being entitled to a reward) and Candidate needs to flag hired (being hired) only if they are 100% sure that the Candidate has been hired but has not been marked hired by the Recruiter on the Site.
    This way the Referrer and/or Candidate notify us when they become aware of any Candidate being employed by a Recruiter which not has been updated yet by the Recruiter on the Site. Flagging is very serious at Referralrecruitment so please flag with care.

    Referralrecruitment keeps statistics such as a unique internal user feedback rating system to gauge and maintain quality of its users like feedback rates on: Recruiters (responsiveness, job fulfillment success rates), Referrers (quality of referrals, referral success rates), Candidates (assessment rates on pre-qualification, relevancy rates), and other ratings.
    Referralrecruitment's users gain star ratings based on the frequency of their activities, and how often they are involved in successful transactions. It will be able to show users how individual's star ratings compare statistically to other users in the system. If the user doesn't have a competitive record, users will favour the requests made by someone who does. Over time, users will strive to maintain high ratings in order to maintain the most rewarding participation in the system.
    Although the internal user feedback rating system is currently not yet visible for all users, due to the time needed to grow and gain more history to calculate accurate ratings, users must already pay attention at establishing a good track record on credibility and reputation once these internal ratings are shared with all users. Referralrecruitment utilizes this collective wisdom to prioritize and to help you make informed decisions about users whom you don't personally know.
    Also the Recruiter can define filter questions for each job, anyone who does not answer the Recruiter's questions correctly the Recruiter can drop before taking the recruitment process further such as the invitation for an interview. In nearby future Referralrecruitment will facilitate the filter questions feature also in the system before a Candidate is able to apply.
    You acknowledge and agree that it is prohibited bringing new business developed through Referralrecruitment offline, apart from the direct offline contact between Recruiters and Candidates in the recruitment process, and anyone attempting to violate this policy will be immediately removed from the Site.
    Referralrecruitment shall not become involved in any dispute which may arise between users. You acknowledge and agree that we do not act as an agent for users nor do we act as an intermediary between users, and that we shall not enter into correspondence or discussions or negotiations with any user on your behalf. You agree to settle any disputes between third parties regarding content such as job postings on your own responsibility. You assume all risks associated with dealing with other users with whom you come in contact through the Site.
    Referralrecruitment is not responsible for damages and disputes from content between Recruiters, Referrers, Candidates and any other third party. If, however, you have legitimate concerns or complaints about a particular user or its activities in connection with the use of the Site, including but not limited to incorrect job postings, unsolicited referral e-mail messages, these can be directed to us using the contact details set out on our Contact Us page.

    For security and privacy reasons, Referralrecruitment will automatically log you out and require you to log in again after a too long period of inactivity. Approximately 45 minutes for a Recruiter and 30 minutes for a Referrer/Candidate, provided the check box "Keep me logged in on this computer" is not checked marked on the Home page.

    You agree to immediately notify Referralrecruitment in any case of violation of the use of the Site and content.
    Without limiting our other remedies, Referralrecruitment reserves the right to deactivate (and consequently not able do any action) or cancel (and consequently not able to login) your right to use the Site at any time and for any reason, including without limitation, where you are in breach of the Terms And Conditions or where we have reasonable grounds to believe that you have breached the Terms And Conditions.

  • Job postings from Recruiters
  • Once registered and logged in, the Recruiter is immediately active and may already posts jobs with Referral Rewards to his Private Job Board (internal/by invitation only) and (if as well to be made public) to the (optional) Public Job Board (external/visible to anyone) on the Site. However, only after verification and approval of: registration of the user (account), subscription (receipt payment), job posting; the job posting will appear open (from suspended) and displayed on the Site (within 1 working day of the date that all conditions have been met).
    If it is the first time job posting it may be you will be contacted.
    Note: by posting a job, the Recruiter is obliged to offer a Referral Reward with a minimum of EUR 1,500 or equivalent (excl. VAT).
    In the job posting, an estimate of the Candidate's first-year gross annual base salary needs to be included in case of a permanent employee or an estimate of the first-year gross annualized base salary based on the daily/hourly rate in case of a temporary employee for the position in question. For the avoidance of doubt, this is simply an estimate and used as a reference and may change depending on the final figures that you agree with the hired Candidate.
    Once you start to post or edit a job listing you need to complete and submit your job posting in one time; it is currently not possible to save the job without posting it to the job board then come back at a later date and complete your posting.
    You can edit the details of a job posting at any time in your user account. Only some fields may be edited in order to keep the most important characteristics of the original job posting the same and not to change it into a completely different job. All changes will affect all submittals and will have also affect on submittals that the Recruiter has already received; for example an increase of the Referral Reward.

    There are no restrictions on: the number of job postings during the subscription term, the duration of a job posting within the subscription term, the number of job postings on behalf of different clients, the number of job referral e-mail messages, the number of job postings or recipients included in the referral e-mail message, the number of Referrers in referral paths, the number of Candidates for each job posting.
    Recruitment agencies, headhunters do not need to disclose their clients' (company) name.
    You can't post jobs of more than one company nor more than one kind of job (listing) within one job posting.
    Under no condition can Referralrecruitment be held liable for possible technical problems and/or shortcomings in mentioned job posting(s) such as display of a logo in case of a Recruiter's company.

    Referralrecruitment offers the ability to collect and review referrals and interest to job postings via the Site. Therefore, if the Recruiter post a job listing, it has to be text only and the Recruiter acknowledges and agrees not to include or reveal his/her e-mail or web address (i.e. no hyperlinks) or any other personal direct contact information in the job description of the job posting.
    In case a person does have important questions, inquiries about a job posting, before becoming a user, referring job(s) to others, expressing interest in a job, the user may contact Referralrecruitment via the Contact Us page.
    Referralrecruitment will contact the Recruiter to get the answers on these questions and/or inquiries on behalf of this person.

    Once a user expresses interest in a job posting, the system will be updated accordingly for the applicable user accounts, the (latent/passive or active) Candidate receives instructions for the application from Referralrecruitment in which also the full name and e-mail id of the Recruiter of the job posting will be disclosed to the Candidate in order to apply (directly). Only the Recruiter receives already a notification in which also some of the Candidate's details will be disclosed such as full name and e-mail id; the Candidate is also copied in this notification e-mail message.

    The Candidate needs to send the application and resume directly to the Recruiter via his/her own personal (confidential) e-mail message application. The Recruiter will contact the Candidate directly to proceed with the recruitment process. We strongly encourage the Recruiter to contact Candidates as quickly as possible and keep them up to date during the time the Recruiter does have the Candidates under review or being accepted.

    The Recruiter acknowledges that Referralrecruitment is not responsible for the quality of the Candidate regarding the job requirements as described by the Recruiter. Therefore Referralrecruitment will give no guarantees whatsoever on the suitability of the Candidate. The Recruiter has the discretion in determining the criteria used in hiring the Candidate(s).

    Detailed and accurate job descriptions are extremely important. The more specific the information the more on-target the Candidates are likely to be. On the Referralrecruitment's job description form you need to include "must haves" which are requirements that are absolutely essential if the Candidate is to be considered qualified. Each Referrer and/or Candidate must to check off every "must have" prior to submitting their referral and/or expressing interest. They are prevented from submitting the referral and/or expressing interest if they cannot confirm that their referral and/or expressed interest and subsequently the application meet your minimum qualifications.

    Please note that Referralrecruitment shall not otherwise become involved in the recruitment process.
    The Recruiter must inform Referralrecruitment immediately via the Contact Us page but in any event within 1 working day when the Recruiter believes that he/she is already aware of the identity of a proposed Candidate via the Site. When the identity is already revealed through the Site the Recruiter must provide proof clearly demonstrating the Recruiter did not get this through the Site. If the Recruiter is not capable in doing so Referralrecruitment will act as if the Candidate is hired through the Site.

    The Recruiter is obliged to keep the job posting such as the job details, the status of the job (in particular when the job posting needs to be closed (withdrawn)), the statuses of Candidates (in particular when the Candidate status needs to be marked "hired") up-to-date. For example the Candidate status is ultimately hired or rejected. We may send the Recruiters reminders to check all of their pending applications. It will also reduce or eliminate any unsolicited e-mails from Referrers or Candidates checking on the status of their referrals or applications.
    Closed jobs will not be shown on the active Public Job Board of the Referralrecruitment website.
    All registered users agree to inform Referralrecruitment via the Contact Us page when they become aware that the job posting is not up-to-date.

    The Recruiter is obliged to fulfill his/her obligation to pay out the Referral Reward and the Referral Success Fee to Referralrecruitment. However, if the Recruiter does not acknowledge the hiring of the Candidate, Referralrecruitment is not responsible for the Referral Reward payment on behalf of the Referrer(s) or for enforcement of the Recruiter's obligation to pay the Referral Reward.
    Referralrecruitment cannot be liable for any disputes between users.

    The Recruiter may use the same job posting for additional/next hires.

    The Recruiter may close (withdraw) the job posting at any time, provided there are no application procedures running anymore and consequently all existing Candidates statuses have been updated from "interested" to "hired" or "rejected". You also understand and agree that the content posted by you may remain on the Site after its closing date for a certain period of time, and you may not be able to remove or delete the content.
    The Recruiter has the obligation to close (withdraw) the job posting immediately when the job posting is cancelled because of hire(s) via the Site or the job position is already filled in another way than via the Site and as result no employee(s) are needed anymore.
    In case the job posting is not true, up-to-date or complete, or in case Referralrecruitment has a reasonable presumption that the job posting is not correct or inappropriate, Referralrecruitment has the right, in its sole discretion, to reject or remove the job posting from the Site.

    Recruiter can increase the level of exposure that a job posting receives such as:
    Job postings may be displayed on the Public Job Board of the Referralrecruitment website and visible to anyone (optional). The jobs postings on the Public Job Board are also included in the major job search engines like Google (Base).
    Referralrecruitment can also distribute job postings via (newsletter) e-mail alerts, RSS, websites (including blogs) with a Referralrecruitment's job listing "widget". A widget is a stand-alone application that can be embedded into third party websites by any user on a page where they have rights of authorship (e.g. a webpage, blog, or profile on a social media site) and potentially earning money for facilitating job postings, referrals and applications. Widgets allow users to turn personal content into dynamic web apps that can be shared on websites where the code can be installed. For example, if user wants to put the Referralrecruitment's job listing "widget" of job postings on his/her own Facebook profile, the user could do this by copying and pasting the embedded code into his/her profile on Facebook.

  • Referrals of Recruiters and Referrers
  • Once the job posting is open, the Recruiter can create a personal referral e-mail message, customized in his/her own language including a job(s) referral track link to job posting(s), and sends/shares via his/her own personal (confidential) e-mail message application(s), by invitation only, further in his/her social network (employees, family, friends, acquaintances).
    A person receives a personal invitation referral e-mail message with job posting(s), directly from the Recruiter or Referrer, or the person sees job posting(s) (if as well made public) displayed on the Public Job Board on the Site. If the person chooses to refer job(s) to others and/or express interest in a job, the person first needs to register as user type Referrer/Candidate (for free) and login on the Site, so that Referralrecruitment's system can add the user to the referral path.
    Once registered and logged in, the user Referrer/Candidate is immediately active and can create a personal referral e-mail message and/or expresses interest in a job, customized/personalized in his/her own language including a job(s) referral track link to job posting(s), and sends/shares via own personal (confidential) e-mail message application(s), by invitation only, further in his/her social network.
    Note: A referral path will only be displayed/visible once a user expresses interest resulting in a referral path of a Candidate. The users see only the referral paths of which they are member. The Administrator of Referralrecruitment may see, for administrative purposes, the referral paths of all users.

    Referralrecruitment keeps track of all referral paths of Referrers which leads to Candidates, possibly multiple degrees of separation across social networks, for all job postings by Recruiters via an unique job(s) referral track link in the referral e-mail message once user registers through Referralrecruitment's website in order to: post job(s), refer job(s) to others who are Candidates or who know good Candidates, and/or express interest in a job.
    The Candidate's (hire's) name will only be disclosed (also) to the Referrer(s) in the referral path once hired.

    There are no restrictions on: the number of job referral e-mail messages, the number of job postings or recipients included in the referral e-mail message, the number of Referrers in referral paths, the number of Candidates for each job posting.
    The user hereby agrees to select only recipients who fit the profile of the Candidate or who know good Candidates. The user agrees to act discreet concerning referred jobs to others and when a user expressed interest in a job, in particular in user's direct work surroundings.
    Referralrecruitment can not be held liable for users' actions accomplished under their own authority.
    The user acknowledges and agrees that under no circumstances there will arise a labour relationship between the user and Referralrecruitment and Referralrecruitment cannot be considered to be an employer with respect to the use of our Site.

  • Applications and resumes of Candidates
  • In case a person does have important questions, inquiries about a job posting, before becoming a user, referring job(s) to others, expressing interest in a job, the user may contact Referralrecruitment via the Contact Us page.
    Referralrecruitment will contact the Recruiter to get already the answers on these questions and/or inquiries on behalf of this person.

    Once a user expresses interest in a job posting, the (latent/passive or active) Candidate receives instructions for the application from Referralrecruitment in which also the full name and e-mail address of the Recruiter of the job posting will be disclosed to the Candidate in order to apply (directly). Only the Recruiter receives already a notification in which also some of the Candidate's details will be disclosed such as full name and e-mail id; the Candidate is also copied in this notification e-mail message. The Candidate needs to send the application and resume directly to the Recruiter via his/her own personal (confidential) e-mail message application.
    The Candidate can only express interest in a job and subsequently apply to this same job once.

    The Candidate (applicant) is solely responsible for the content of the application and the resume and the direct sending to the Recruiter. This means that no resume information of the Candidates is kept on the Referralrecruitment Site. The Recruiter will contact the Candidate directly to proceed with the recruitment process. Please note that Referralrecruitment shall not otherwise become involved in the recruitment process. The Recruiter has the discretion in determining the criteria used in hiring the Candidate(s).
    The Candidate's (hire's) name will only be disclosed (also) to the Referrer(s) in the referral path once hired.
    There is no restriction on the number of Candidates for each job posting.

    In case resumes are accidentally received by Referralrecruitment, Referralrecruitment agrees to deal discretely with the received resumes and will observe the provisions of the Privacy Policy.
    Recruiters of positions on the Site will include various businesses from a range of market sectors and could include individual companies and recruitment agencies. Whilst Referralrecruitment shall use its best efforts in good faith to check that Recruiters who advertise job positions on the Site are legitimate businesses, you acknowledge that by providing your details to a Recruiter, Referralrecruitment is simply introducing you to the Recruiter and are not endorsing or recommending the Recruiter nor making any warranties or representations about the Recruiter's business activities or any position which is claimed to be offered. We suggest that you use common sense and exercise normal caution when making arrangements to visit or meet with Recruiters.
    Under no circumstances Referralrecruitment can be held liable for the content of the resumes or related damages or loss, for the behaviour of Recruiters concerning the applications and resumes sent.

  • Proprietary rights
  • Referralrecruitment respects the intellectual property rights of others, and we ask you to do the same. Our Site may contain an assortment of information, data, software, images, video clips, music, links, logos and other material that are the copyright, trademark or other intellectual property of the owners of the Site or third party suppliers.The content on the Site is copyrighted individually and as a collective work.
    The name Referralrecruitment and the logo on the Site are trademarks or registered trademarks of Referralrecruitment. The names, logos or other trademarks of any other companies, services and/or products appearing on or in the Site are the trademarks of their respective owners.

    You acknowledge and agree that no title in and to the Site, including the intellectual property rights therein, is transferred to you, and you will not acquire any rights to the Site, except for the rights as expressly granted herein.

    You represent and warrant that the information submitted on or through the Site does not violate the privacy rights, publicity rights, trademark rights, copyrights, contract rights or any other rights of any person. You will ensure that all copyright, trademark or other proprietary rights notices appearing on any content remain intact and legible. All licenses are non-exclusive.
    You agree to pay for all royalties, fees and any other monies owing any person by reason of any information submitted by you to or through the Site.
    Any and all ideas, suggestions, modifications and the like provided by you with respect to the Site will be the property of Referralrecruitment.

  • Links and third party content
  • The Site may contain links to third party websites such as job listing widgets and Referralrecruitment may display content from third parties on our Site such as advertisements. These links are provided solely as a convenience to you, at your own risk, and not as an endorsement by Referralrecruitment of the contents on such third party websites. You should check the Terms And Conditions and Privacy Policy when you visit them. Referralrecruitment is under no circumstances responsible or liable for the access to or the accuracy of the contents on such third party websites and the accuracy of the third party content on our Site.
    You may not display our content within a frame or border, or deep link or harvest content located below our top-most URL. You will not link to our Site or content in a manner that suggests an endorsement or affiliation between our sites, unless Referralrecruitment expressly consents in advance to such linking and/or framing. You will remove any link to our Site and/or frame of content on our Site that we find objectionable promptly upon request.

  • Reservation of rights
  • The Site shall only be used by you for your personal and/or internal business purposes, and you agree not to distribute the data available through the Site to any third party that is not a registered user of the Site, except as expressly permitted by the Terms And Conditions. The data submitted to a user account remains the property of the user.
    User-posted commercial advertisements, affiliate links and other forms of solicitation or profiteering may be removed from your (user) account without notice and result in the cancellation of your (user) account.

    All content, communications, software applications, digital products, updates and features of the Site are copyrighted by the Site, its owners, suppliers or other third parties. Referralrecruitment reserves all rights not expressly granted to you. This means permission to use the Site and related intellectual property rights will be narrowly interpreted by a court in our favour.
    There are no implied rights. Except as otherwise required, limited by applicable law, or as specifically authorized in the Terms And Conditions, any reproduction, distribution, modification, retransmission, or publication of any copyrighted material is strictly prohibited without the express written consent of the copyright owner or license.
    You shall not assist or permit any third party computer system to access the Site. You may not reverse engineer our Site or any software obtained from it to discover its underlying design or inner workings (and you will hold in confidence for our benefit alone anything discovered in violation of this provision). If you infringe our intellectual property rights or exceed the scope of permitted use of the Terms And Conditions, you agree that Referralrecruitment could be irreparably injured and may obtain a court order without necessity of posting bond to enjoin you from further mischief.

    You agree to take all reasonable steps to protect the data contained on the Site accessed on the Site from unauthorized access, copying or use. Referralrecruitment may, in appropriate circumstances and at our discretion, terminate the access to the Site for users who infringe the intellectual property rights of others.
    Please note that for copyright infringements, any person, who knowingly materially misrepresents that material or activity is infringing, may be subject to liability.
    Referralrecruitment retains the right, but do not have an obligation, to immediately stop any posting or transaction. We may prevent or restrict access to the Site. We do not endorse any user content and will not be held liable for any warranties made by users.

    Invoicing And Payments

    In using the Site, you agree to comply with the invoicing and payments as described herein.

    There is no cost to browse the Site as a visitor.
    Referralrecruitment charges fees to Recruiters who become registered users and use our Site, and hire successfully Candidates via the Site.
    Referralrecruitment refunds Recruiters partially if the hired Candidate is rejected (employment terminated) within (employed less than) 60 calendar days of the start date of employment.
    There is no cost to become a Referrer/Candidate. Referralrecruitment disburses (distributes) rewards to Referrer(s) who facilitated successfully the hiring of a Candidate.
    Referralrecruitment compensates Affiliates for their marketing efforts to direct (invite) new registered Recruiters to our Site.

  • For Recruiters
  • By registering and using our Site, the Recruiter is entering into a contract based on a per-user access fee, the Recruiter is expressly agreeing that Referralrecruitment is permitted to invoice the Recruiter upon registration (subscription). The Recruiter agrees to pay Referralrecruitment:

    • the Company Subscription Invoice with:
      • Subscription Fee EUR 250 (or equivalent) (excl. VAT) (1 user account, subscription period (term) of 6 months, unlimited job postings (duration)) for Referralrecruitment.

    Invoice date is start date of subscription.

    All payments in Euros (or equivalent) are payable to Referralrecruitment within 14 days of the date of invoice.
    If the status of the Recruiter has been changed to active and the Recruiter didn't get a reaction from us, please contact us via the Contact Us page to notify us to pay the Subscription Fee (membership fee).

    Note: membership is for one user account (e-mail id/user-id) and may be shared with another colleagues within the same registered company but not with users of any other company. Violation of this rule will result in cancellation of your membership.

    Upon expiration of the subscription term (membership period), the subscription will be automatically renewed (extended) and as result charged based on a recurring billing cycle unless it is terminated (cancelled) in writing before or at the end date of subscription by the Recruiter. In case of no termination by the Recruiter and as result the auto-renewal will be applicable, the subscription will be automatically extended for successive renewal periods of the same duration as the subscription term originally selected, at the then-current Subscription Fee. Your non-termination or continued (renewed) use of the Site reaffirms that Referralrecruitment is authorized to charge you in accordance with the Terms And Conditions.
    To terminate (cancel) your subscription at any time prior to the next subscription term and billing cycle, go to "My Profile" and change field "User Status" into "Terminated". Note: Only change user status to "terminated" if you do not use your subscription (term) anymore as you will not be able to login anymore and may not use your subscription until the end of your then-current subscription term. Once the user status is changed to "terminated" on or before the end date subscription, your subscription will not be renewed after your then-current term expires. You may request termination of the user account (cancellation of membership) also via the Contact Us page.

    Once you have terminated your user account, you are still obliged to pay any pending obligations.You will not be eligible for a pro-rated refund/credit of any portion of the Subscription Fee paid for the then-current subscription period and/or Referral Rewards paid for hired Candidates that are subsequently unsuccessfully placed. When all obligations have been met your user account will be subsequently deleted.
    In case you want to cancel the termination in order to subscribe again send a request via the Contact Us page.

    By posting a job on the Site, the Recruiter is entering into a contract based on a pay-per-hire job posting, the Recruiter is obliged to offer a Referral Reward with a minimum of EUR 1,500 or equivalent (excl. VAT). The Recruiter agrees to pay the Referral Success Invoice to Referralrecruitment if the Recruiter hires a Candidate that applies or is referred via Referralrecruitment to the conditions described in your job listing and reward conditions you posted.
    You agree not to post a job with a Referral Reward and its related fees that you cannot pay or do not intend to pay.
    Only registered users (Referrers) in the successful referral path to the hired Candidate (excluding the Recruiter) are eligible for (entitled to) the Referral Reward.

    When the Recruiter signs an employment agreement (temporary or for an undefined period) with a Candidate proposed through the Site, or the Candidate signs an employment agreement with a third party, other than the Recruiter, but with intermediate services from the Recruiter, resulting from a proposal on the Site, the Recruiter must report the start of the employment on the Site on or before the hiring by going to the "Candidate Details" web page and completing the field 'Start Date Employment" and clicking the "Hire" button.

    (Only) upon hiring a Candidate for any Recruiter's job via the Site, the Recruiter is entering into a contract, the Recruiter agrees to pay Referralrecruitment:

    • the Referral Success Invoice with:
      • Referral Reward (with a minimum of EUR 1,500 or equivalent) (excl. VAT) on behalf of the Referrer(s).
      • Referral Success Fee (25% of the Referral Reward with a minimum of EUR 750 or equivalent) (excl. VAT) for Referralrecruitment.

    Invoice date is start date of employment.

    If you do not hire a Candidate through Referralrecruitment you will not be charged the Referral Reward or Referral Success Fee.

    Recruiter may use the same job posting for additional/next hires. For each Candidate hired per job posting via the Site, the Referral Success Invoice is applicable, even if a Candidate is hired via the Site for a different job position than the Recruiter posted.

    Note: the Recruiter is allowed to modify the Referral Reward between the date of posting and the date of hiring. This modification may only be an increase of the Referral Reward. All other related amounts will then also be updated accordingly.
    All payments in Euros (or equivalent) are payable to Referralrecruitment within 14 days of the date of invoice.

    If the status of the Candidate has been changed to "hired" and the Recruiter didn't get a reaction from us, please contact us via the Contact Us page to notify us to pay the Referral Success Invoice.

    The Recruiter has to pay the Referral Reward and the Referral Success Fee associated with the hiring directly to Referralrecruitment and Referralrecruitment will pay the Referral Reward to the Referrer(s). So the Recruiter does not have to pay the Referral Reward directly to the Referrer(s).
    Full disbursement (distribution) of the Referral Reward to the Referrer(s) in the successful referral path is conditional and will only take place after receipt payment from the Recruiter and if the guarantee expires 60 calendar days after the start date of employment (like a probation period) of the new hired Candidate for the referral process to be complete.
    After the 60th day, payment processing to the Referrer(s) will begin and no refund to the Recruiter will be possible.

    If the employment of the Candidate hired is terminated within (employed less than) 60 calendar days of the start date of employment (like a probation period), you are eligible for a Referral Reward refund.
    To receive this 60-day money back guarantee (only) on the Referral Reward, the Recruiter must report the termination of the employment on the Site on or before the 60th calendar day, by going to the "Candidate Details" web page and completing the 'End Date Employment" field and clicking the "Reject" button.

    Upon rejecting (terminating the employment of) the hired Candidate within the 60-day guarantee period, Referralrecruitment agrees to pay the Recruiter:

    • the Credit Referral Reward Invoice with:
      • Credit Referral Reward (excl. VAT) for Recruiter

    Invoice date is end date of employment.

    All payments in Euros (or equivalent) are payable to the Recruiter within 14 days of the date of invoice.
    If the status of the Recruiter's hired Candidate has been changed to "rejected" and the Recruiter didn't get a reaction from us, please contact us via the Contact Us page to collect the Credit Referral Reward.The Recruiter must claim the Credit Referral Reward within 30 days of the end date of employment. If the Recruiter does not, his/her right to receive payment will terminate.
    If the hired Candidate leaves after the guarantee period not any refund to the Recruiter will be applicable.

    In case of a direct hired Candidate (hire) by the Recruiter through Referralrecruitment, no Referral Reward will be applicable but only the Referral Success Fee. This means that a user (direct contact) who applies directly through Referralrecruitment and gets hired will not receive the Referral Reward himself/herself.

    Referrers own the Candidates they refer/submit for as long the job posting exists; the Recruiter owes a reward if, during this period, he/she hires a Candidate for his/her job posting.
    If the Recruiter hires a Candidate, who was initially referred through Referralrecruitment, for an another job and/or at a later moment the Recruiter is still obliged to pay the Referral Reward plus the Referral Success Fee to Referralrecruitment.
    Candidates who applied to a Recruiter outside of Referralrecruitment in the preceding 6 months belong to that Recruiter, and not the submitting Referrer or Referralrecruitment; i.e., if the Recruiter hires the Candidate, the Recruiter will not owe a reward and/or fee.

    The Recruiter agrees, also on behalf of his/her client and any other third party in case the Recruiter acts as a professional third party recruiter (at a recruitment agency, acting on behalf of clients), to keep any Candidate details confidential in compliance with the relevant privacy legislation regarding protection of personal data.
    The Recruiter agrees to notify Referralrecruitment immediately should any hire be made by report the hiring on the Site under "Candidate Details" and the button "Hire".
    The Recruiter agrees to pay the Referral Success Invoice for any Hire for a job posting on the Site or for a(n) (another) job not posted on the Site but the hired Candidate comes via Referralrecruitment.
    The disclosure by the Recruiter to a third party, also other than his/her client in case the Recruiter acts as a professional third party recruiter (at a recruitment agency, acting on behalf of clients), of any Candidate details introduced through Referralrecruitment, which results in an engagement with that third party, renders the Recruiter liable to payment of the Referral Success Invoice with no entitlement to any refund.

  • For Referrers
  • If a person chooses to refer job(s) to others and/or express interest in a job, the person first needs to register (for free) and login on the Site, so that Referralrecruitment's system can add the user to the referral path.
    If the user does not register and login, the user will not be eligible to earn (a share of) any Referral Reward offered.

    The Referral Reward will be shared equally by the number of registered persons (Referrers), in the first successful referral path, who have together connected the hiring organization (Recruiter) and the hired Candidate (hire). Upon hiring of the Candidate by the Recruiter, Referralrecruitment shall contact each Referrer by e-mail to notify him/her of this and to arrange payment of his/her share (portion) of the Referral Reward, each Referrer in the successful referral path will receive by e-mail a Referral Reward Voucher as written proof that they are entitled to receive the applicable disbursement (distribution) of the Referral Reward from Referralrecruitment when all conditions are met.

    Thus, upon hiring a Candidate, Referralrecruitment agrees to pay the Referrer:

    • the Referral Reward Voucher with:
      • Referral Reward (equally shared) (excl. VAT) for Referrer(s.)

    Invoice/voucher date is 60 calendar days after the start date of employment.

    Note: the Recruiter is allowed to modify the Referral Reward between the date of posting and the date of hiring. This modification may only be an increase of the Referral Reward. All other related amounts will then also be updated accordingly.

    All payments in Euros (or equivalent) are payable to the Referrer within 14 days of the date of invoice/voucher.
    If the status of the Referrer's referred Candidate has been changed to "hired" and the Referrer didn't get a reaction from us, please contact us via the Contact Us page to collect the Referral Reward.
    The Referrer must claim his/her share of the Referral Reward as soon as the hired Candidate starts his/her new job in order for you to be eligible to receive your portion of it, but in any event within 90 days of the start date of employment via the Contact Us page. If the Referrer does not, his/her right/claim to receive payment will terminate.

    Referralrecruitment will not be able to disburse monies to the Referrer(s) unless we have received payment of the Referral Reward from the Recruiter that originally posted the job. There are no assurances that the Referrer(s) will receive the Referral Reward if the Recruiter does not pay. Under no circumstances Referralrecruitment can be held liable for not paying the Referral Reward by the Recruiter to Referralrecruitment (on behalf of the Referrer(s)) and consequently not able to pay (distribute) the disbursement to the Referrer(s).

    When the Candidate hired (hire) has completed 60 calendar days of employment, the payment process of the Referral Reward Vouchers will proceed and no refund to the Recruiter will be possible.
    If the Referrer earns a Referral Reward and is a tax payer, the Referrer is in all cases at any time personally responsible to declare the income to comply with the local tax authorities, fiscally the Referral Reward may be considered as a "conciliation fee" typically categorised under remaining income of labour or similar, and for paying any taxes which becomes due by you as a result of our payment to you of the Referral Reward. Referralrecruitment can be in no manner be held liable for not fulfilling this obligation.

    Referralrecruitment will fully comply with disclosure requirements as required by the tax authorities for monies disbursed by Referralrecruitment to the Referrer and thus may ask the Referrer for relevant personal information to facilitate such disclosure. Referralrecruitment will not be able to disburse monies to the Referrer unless he/she will have provided such information like copy passport, id-card, tax identification number, social security number, residence.

    Only the Referral Reward Voucher sent by e-mail by Referralrecruitment to the Referrer(s) in the successful referral path is considered valid. All Referral Reward Vouchers will be subject to verification at the time of presentation. Any other use of such materials, including any copying, reproduction, modification, sale, distribution, transmission, republication, downloading, display, posting, performance, or other exploitation thereof by any means or medium without the prior written permission of Referralrecruitment will render the Referral Reward Voucher invalid.

    In lieu of personally accepting a Referral Reward for the participation of the Referrer in a successful hire, the Referrer have the option to donate his/her share of the Referral Reward to a charity of his/her own choice. Referralrecruitment can also make this donation in the Referrer's name.
    In case the Referrer decides to donate his/her full Referral Reward amount to a charity, Referralrecruitment will in addition also donate half of its Referral Success Fee to this same charity, provided the Referrer will have Referralrecruitment make this joint donation (in the Referrer's and Referralrecruitment's names). Referralrecruitent will provide proof of this joint donation to the Referrer.
    Well-known charity organizations are: UNICEF, World Wide Fund for Nature/World Wildlife Fund, Amnesty International, Red Cross.

    In case of a direct hired Candidate (hire) by the Recruiter through Referralrecruitment, no Referral Reward will be applicable but only the Referral Success Fee. This means that a user (direct contact) who applies directly through Referralrecruitment and gets hired will not receive the Referral Reward. Note: if a user refers first himself/herself, it is still treated as a direct hire as he/she is the same person. Though, in case the Candidate asks a friend to refer first, then also the Referral Reward will be applicable (upon discretion to be shared with this friend as "stand-in-Referrer").

    Referralrecruitment prevents that more than one Referrer in different referral paths can refer one and the same Candidate that is hired for the same job posting.
    In case the same job has already been referred to a user (Referrer/Candidate), only the first job referred in the applicable referral path will be taken into account and displayed and any other duplicated job referred will be blocked (null and void). Thus only the Referrer(s) in the first successful referral path who referred the job to the hired Candidate will be (equally) rewarded.

    In the unlikely event that the system fails to block a duplicate submission, the winner of the reward will be Referrer(s) in the referral path who first submitted the Candidate, as determined by the date and time stamp on the submissions.

    Referralrecruitment prevents a bypass (circumvention) of already existing referral paths via the Public Job Board of the same user for the same job.
    If a user wants to refer job(s) to others and/or express interest in a job on the Public Job Board but the same user is for the same job already a member in an existing referral path then the bypassed (circumvented) part of the existing referral path will also be taken into account (added) once this new referral path is created i.e. it is applicable in the event that the job offering is "private and public" (internal and external/visible to anyone) and the same job posting is referred by the same user e-mail id as a member in an already existing referral path.

    Referrers own the Candidates they refer/submit for as long the job posting exists; the Recruiter owes a reward if, during this period, he/she hires a Candidate for his/her job posting.
    Candidates who applied to a Recruiter outside of Referralrecruitment in the preceding six months belong to that Recruiter, and not the submitting Referrer or Referralrecruitment. If the Recruiter hires the Candidate, the Recruiter will not owe a reward and/or fee.

    Important: to be eligible for the Referral Reward, a person must not reply or forward the referral e-mail message but must click on the system-generated job(s) referral track link to see job(s) details to refer job(s) to others and/or express interest in a job and to register as a member of the referral path.
    If the person is not a registered user then he/she needs to register first on the Site. If the person is already a registered user then he/she needs to login and refer to others and/or express interest.
    A person is never entitled to claim the Referral Reward if he/she informed the hired Candidate about the job posting by not registering on the Site and using a different manner to inform the Candidate e.g. by just forwarding the e-mail, or calling the Candidate.
    Thus, only registered users (Referrers) in the successful referral path to the hired Candidate (excluding the Recruiter) are eligible for the Referral Reward.

    While Referralrecruitment shall make every effort to track the progress of job postings and referrals, we shall not be responsible for the failure by the Recruiter to inform us of the hire of a Candidate. We recommend that the user maintains contact with the Referrers and Candidates (although the names of Candidates and their contact information are withheld (kept confidential) at this point for all Referrers if they are not hired yet) and notify us via the button "Flag Reward" on the web page "Candidate Details" on the Site and/or via the Contact Us page when you believe and/or become aware you have made a successful referral of any Candidate being employed by a Recruiter which has not been updated yet by the Recruiter on the Site. It is a good idea to make sure that the members of a referral path are happy for each other being in the referral path in particular the Candidate for the Referrers, which also ensures that everybody will get their share of the Referral Reward in case the Candidate is successfully hired. We recommend that Referrers keeping in touch with any other Referrer and the Candidate in the successful referral path and to see when the Candidate starts with the Recruiter and letting Referralrecruitment know via the Contact Us page if you get this information.
    If a Recruiter informs Referralrecruitment of a successful referral before you do we will of course relay to you to let you know and arrange payment.
    When Referralrecruitment is informed by you of a successful referral we shall use reasonable endeavours to verify this and obtain the payment of the Referral Success Invoice including the Referral Reward on behalf of the Referrer(s).

    To terminate (cancel) your registration at any time, go to "My Profile" and change field "User Status" into "Terminated". Note: Only change user status to "terminated" if you do not use your registration anymore as you will not be able to login anymore.
    Once you have terminated your user account, you will not be eligible for any Referral Rewards earned on behalf of Referrers from Recruiters for Candidates that are subsequently successfully placed. When all obligations have been met your user account will be subsequently deleted.
    In case you want to cancel the termination in order to register again send a request via the Contact Us page.

  • For Candidates
  • In principle no invoicing and/or payments are applicable for Candidates and/or hired Candidates (hires).
    Note: the Recruiter is allowed to modify the Referral Reward between the date of posting and the date of hiring. This modification may only be an increase of the Referral Reward. All other related amounts will then also be updated accordingly.

    In case of a direct hired Candidate (hire) by the Recruiter through Referralrecruitment, no Referral Reward will be applicable but only the Referral Success Fee. This means that a user (direct contact) who applies directly through Referralrecruitment and gets hired will not receive the Referral Reward. Note: if a user refers first himself/herself, it is still treated as a direct hire as he/she is the same person. Though, in case the Candidate asks a friend to refer first, then also the Referral Reward will be applicable (upon discretion to be shared with this friend as "stand-in-Referrer").

    Referralrecruitment prevents that more than one Referrer in different referral paths can refer one and the same Candidate that is hired for the same job posting.
    In case the same job has already been referred to a user (Referrer/Candidate), only the first job referred in the applicable referral path will be taken into account and displayed and any other duplicated job referred will be blocked (null and void). Thus only the Referrer(s) in the first successful referral path who referred the job to the hired Candidate will be (equally) rewarded.

    In the unlikely event that the system fails to block a duplicate submission, the winner of the reward will be Referrer(s) in the referral path who first submitted the Candidate, as determined by the date and time stamp on the submissions.

    Referralrecruitment prevents a bypass (circumvention) of already existing referral paths via the Public Job Board of the same user for the same job.
    If a user wants to refer job(s) to others and/or express interest in a job on the Public Job Board but the same user is for the same job already a member in an existing referral path then the bypassed (circumvented) part of the existing referral path will also be taken into account (added) once this new referral path is created i.e. it is applicable in the event that the job offering is "private and public" (internal and external/visible to anyone) and the same job posting is referred by the same user e-mail id as a member in an already existing referral path.

    Referrers own the Candidates they refer/submit for as long the job posting exists; the Recruiter owes a reward if, during this period, he/she hires a Candidate for his/her job posting.
    Candidates who applied to a Recruiter outside of Referralrecruitment in the preceding six months belong to that Recruiter, and not the submitting Referrer or Referralrecruitment. If the Recruiter hires the Candidate, the Recruiter will not owe a reward and/or fee.

    While Referralrecruitment shall make every effort to track the progress of job postings and referrals, we shall not be responsible for the failure by the Recruiter to inform us of the hire of a Candidate. We recommend that the user maintains contact with the Referrers and Candidates (although the names of the Candidates and their contact information are withheld (kept confidential) at this point for all Referrers if they are not hired yet) and inform us via the button "Flag Hired" on the web page "Candidate Details" on the Site and/or via the Contact Us page when you have been hired and by a Recruiter which has not been updated yet by the Recruiter on the Site. It is a good idea to make sure that the members of a referral path are happy for each other being in the referral path in particular the Candidate for the Referrers, which also ensures that everybody will get their share of the Referral Reward in case the Candidate is successfully hired. When Referralrecruitment is informed by you of a successful hiring we shall use reasonable endeavours to verify this and obtain the payment of the Referral Success Invoice including the Referral Reward on behalf of the Referrer(s) who helped you to get the job.

    To terminate (cancel) your registration at any time, go to "My Profile" and change field "User Status" into "Terminated". Note: Only change user status to "terminated" if you do not use your registration anymore as you will not be able to login anymore.
    Once you have terminated your user account, you will not be eligible for any Referral Rewards earned on behalf of Referrers from Recruiters for Candidates that are subsequently successfully placed. When all obligations have been met your user account will be subsequently deleted.
    In case you want to cancel the termination in order to register again send a request via the Contact Us page.

  • For Affiliates
  • (Only) once a person or organization is engaged (appointed) by Referralrecruitment as an Affiliate in our Affiliate Program, for the purpose of directing (inviting/introducing) Recruiters for registration to the Site, Referralrecruitment will compensate the Affiliate (person/organization) with an Affiliate Voucher with an Affiliate Fee of 30% of the Recruiter's Subscription Fee for each new registered (subscribed) Recruiter to the Site. The Recruiter must fill in upon registration on the "Registration" web page the field "How did you hear about Referralrecruitment?" and select "Affiliate" and fill in the field "Name" the full name and the e-mail id of the Affiliate in order to be able to compensate the Affiliate by Referralrecruitment for his/her/its marketing efforts.
    Upon subscription of the new Recruiter directed by the Affiliate, the Affiliate will receive by e-mail an Affiliate Voucher as written proof that the Affiliate is entitled to receive the applicable payment of the Affiliate Fee from Referralrecruitment when all conditions are met.

    Thus, upon registration (subscription) of a new Recruiter, directed (invited/introduced) by the Affiliate, to the Site, Referralrecruitment agrees to pay the Affiliate:

    • the Affiliate Voucher with:
      • Affiliate Fee (30% of the Recruiter's Company Subscription Invoice with Subscription Fee) (excl. VAT) for Affiliate.
        (For example, if the Recruiter's Company Subscription Invoice with the Subscription Fee is EUR 250 (or equivalent) (excl. VAT) then the Affiliate Voucher with its Affiliate Fee is EUR 75 (or equivalent) (excl. VAT)).

    Voucher date is Recruiter's start date of subscription.
    Note: All separate Affiliate Vouchers with its voucher dates during the month will be totalled to one (summarized) monthly Affiliate Voucher at month-end.
    Invoice/monthly voucher date is month-end date.

    All payments in Euros (or equivalent) are payable to the Affiliate within 14 days of the date of invoice/monthly voucher.
    If the status of the Affiliate's directed (invited/introduced) Recruiter has been changed to active and the Affiliate didn't get a reaction from us, please contact us via the Contact Us page to collect your Affiliate Fee.
    The Affiliate must claim his/her/its Affiliate Fee within 60 days of the registration date of the directed Recruiter. If the Affiliate does not, his/her/its right to receive payment will terminate.

    Referralrecruitment will not be able to pay out monies to the Affiliate unless we have written proof as described above from the Recruiter upon registration that he/she got directed by the Affiliate and from the Affiliate a notification e-mail via the Contact Us page before or on the registration date of the Recruiter on the Site that the Affiliate directed the Recruiter. Under no circumstances Referralrecruitment can be held liable for not paying the Affiliate Fee to the Affiliate if no written proof received in time by Referralrecruitment from both the Recruiter and the Affiliate before or on the registration date of the Recruiter on the Site.
    No Affiliate Fee will be applicable in case of: a direct registration of the Recruiter through Referralrecruitment i.e. without mentioning the name of the Affiliate, the person or organization has not been engaged (appointed) as an Affiliate, or no notification e-mail from the Affiliate via the Contact Us page with full name and e-mail id of the Recruiter before or on the registration date of the Recruiter.
    Referralrecruitment will not be held responsible for any disputes between Recruiters and Affiliates or any other users.

    If the Affiliate earns an Affiliate Fee and is a tax payer, the Affiliate is in all cases at any time responsible to declare the income to comply with the local tax authorities. Fiscally the Affiliate Fee may be considered as a "bring-in fee" typically categorised under remaining income of labour or similar. Referralrecruitment can be in no manner be held liable for not fulfilling this obligation.
    Referralrecruitment will fully comply with disclosure requirements as required by the tax authorities for monies paid by Referralrecruitment to the Affiliate and thus may ask the Affiliate for relevant personal/corporate information to facilitate such disclosure. Referralrecruitment will not be able to pay out monies to the Affiliate unless he/she/it will have provided such information like copy passport, id-card, tax identification number, social security number, residence.
    Only the Affiliate Voucher sent by e-mail by Referralrecruitment to the Affiliate for a successful registration of a new Recruiter is considered valid. All Affiliate Vouchers will be subject to verification at the time of presentation. Any other use of such materials, including any copying, reproduction, modification, sale, distribution, transmission, republication, downloading, display, posting, performance, or other exploitation thereof by any means or medium without the prior written permission of Referralrecruitment will render the Affiliate Voucher invalid.

    The registration of a new Recruiter can only be directed by one Affiliate who directed the Recruiter first on or before the registration date of the new Recruiter. Any other Affiliates for the same Recruiter will be ignored (null and void).

    The Affiliate hereby agrees to select only Recruiters who might be interested to use Referralrecruitment.
    The Affiliate agrees to act discreet concerning the registration of the Recruiter on the Site.
    Referralrecruitment can not be held liable for Affiliate's actions accomplished under his/her/its own authority.
    The Affiliate acknowledges and agrees that under no circumstances there will arise a labour relationship between the Affiliate and Referralrecruitment and Referralrecruitment cannot be considered to be an employer with respect to the Affiliate.
    Referralrecruitment is at all times entitled to stop the engagement with the Affiliate without reason.

    Note: Referralrecruitment may engage (appoint) as well websites as an Affiliate in our Affiliate Program, for the purpose of facilitating job postings, referrals and applications in order to find Candidates. Affiliate websites will receive Referralrecruitment's job listing widgets and in return be compensated with a beforehand mutually agreed Affiliate Fee and its terms stipulated on a case by case basis.

    You agree that you will not circumvent our billing process or fee structure or arrange behind the back transactions that avoid paying the fees owed to Referralrecruitment and its users.
    Referralrecruitment reserves the right to vary from time to time all fees and rates such as (minimum) amounts or percentages, with or without notice. When aforementioned occurs, Referralrecruitment will immediately mention this on the Site. Activities, such as registrations with the date of registration, jobs postings with the date of posting, before this date of mention, will be invoiced according to the then current fees and/or rates.

    As we will need your banking or account details to complete any financial transaction we will contact you always first.
    All invoices, vouchers and any other documents are sent as an attachment in e-mail message only, we do not issue paper invoices.
    All payments between all parties will be executed by a method we specify which will be in most cases a bank transfer into a bank account or online via PayPal to the e-mail address also registered in the member's account at Referralrecruitment. One of the conditions to register is to have a bank account and/or PayPal account in the name and/or e-mail id you used to register at Referralrecruitment.com. Payments cannot be processed in names and/or e-mail id's other than that of the names and/or e-mail id's registered. Any costs and expenses such as bank (transfer) charges incurred by you in respect of the payment method will be borne by you. You will be paid by a bank transfer into you bank account or online via PayPal to your e-mail address also registered in your member's account at Referralrecruitment.
    Upon invoicing, all amounts will be charged including VAT if applicable. User agrees to provide VAT number if applicable.
    Note: The currency exchange rate used in the system during the month will the month-end currency exchange rate of the previous month used from the website www.oanda.com, the largest currency exchange rate database on the internet.
    Referralrecruitment reserves the right to correct any errors or mistakes that it makes even if it has already requested or received payment.

    Referralrecruitment will do everything in its power to ensure invoices are paid on time and in full, however we aren't responsible for overdue or refusal of payments payable to us. For the avoidance of doubt, we are unable to pay fees until we have been paid in full. Only when funds have been cleared, Referralrecruitment will pay fees to users.
    Upon financial settlement between Referralrecruitment and the user, Referralrecruitment will contact the user and the user agrees to provide the necessary additional financial information, not yet recorded on the Site prior to any financial transaction being made to you e.g. complete invoicing details of the Recruiter, complete payment details of the Referrer and Affiliate in order to be able to complete the invoicing and/or payments by Referralrecruitment with the user. It is the user's responsibility to provide the (before) mentioned financial details as soon as possible to Referralrecruitment.
    Late payments to Referralrecruitment are subject to costs of collection (including reasonable legal fees such as but not limited to collection fees) which is 15% of the total amount due, and shall bear interest at a rate equal to one percent (1 %) per month or the highest rate permitted by law in case this is higher, whereby a part of the month will be counted as one full month.
    Failure to pay the applicable fees or charges when due, may result in a terminated account.
    All persons and companies registered with Referralrecruitment receiving funds from Referralrecruitment are responsible for their own tax liability. You are responsible for paying any tax which becomes due by you as a result of our payment to you such as the (Credit) Referral Reward and Affiliate Fee and indemnify us against any liability for tax (such as income, VAT) due by you which results from such payment. Referralrecruitment can be in no case held responsible for any financial claims relating to tax issues (such as income, VAT) of users.

    If Referralrecruitment terminates your (user) account because you have breached the Terms And Conditions, you will be still obligated to pay the open invoices, and you will not be entitled to any payment to you, if any.
    Any communications regarding invoicing and payments must be made to Referralrecruitment and not to users themselves. Failure to abide by this clause will nullify any right you may have to claim a payment (receipt).
    All users such as Recruiter, Referrer, Candidate, Affiliate and others fully indemnify Referralrecruitment against any claims brought against Referralrecruitment by these users.

    Representations And Warranties

    The parties represent and warrant that they have full power to enter into and perform their obligations under the Terms And Conditions and have taken all necessary action to that effect, and they have obtained and will maintain throughout the Terms And Conditions, all rights, licences, permissions and approvals, including all registrations in accordance with and as required by the applicable data protection legislation, which are necessary.

    No Outside Contacts

    Because of the uncertainty and lack of uniformity of laws in other jurisdictions (particularly as applied to internet sites), it is important to agree that our Site operates solely in Amsterdam, The Netherlands (Europe) (our locality). You are using the internet as your own agent to access and use our Site from the local internet Point Of Presence (POP) here in our locality and you are using the internet or public carrier as your local agent to take delivery of any information, products or services in our locality. This means all operations, services, deliveries, performance and contacts of our Site occur solely in our locality. Our Site does not submit to personal jurisdiction anywhere else and you irrevocably waive any claim to the contrary.

    Injunctive Relief

    If you violate or exceed the scope of the Terms And Conditions or infringe our proprietary rights, you agree we would be irreparably harmed and may (in addition to other relief and without having to post bond) obtain a court order enjoining you from further mischief.

    Technology And Data Transfer

  • Technology transfer
  • The transport of technology, technical data and information across national boundaries is regulated by The Netherlands and certain foreign governments. You agree not to directly or indirectly export or re-export any information, software or technology obtained from or through the Site that requires an export license or governmental approval without first obtaining that license or approval. This provision will survive termination of our Terms And Conditions.

  • European Union residents
  • If you reside in the European Union (EU) or if any transfer of information between you and our Site is governed by the European Union Data Protection Directive or national laws implementing that Directive, then you consent to the transfer of such information outside of the European Union to your country and to such other countries as may be contemplated by the features and activities provided by the Site.

  • California residents
  • If you are a California resident, you waive California Civil Code Section 1542, which says: "A general release does not extend to claims which the creditor does not know or suspect to exist in his favour at the time of executing the release, which if known by him must materially affected this settlement with the debtor."

    U.S. Government Restricted Rights

    To the extent used by U.S. government personnel: this is a computer data base that constitutes restricted computer software and is provided with RESTRICTED RIGHTS. Use, duplication or disclosure by the Government is subject to restrictions as set forth in the Commercial Computer Software clause at DFARS. Contractor is Referralrecruitment, a company with offices located in Amsterdam, The Netherlands (Europe).

    Relationship Of Parties

    There are no third party beneficiaries of the Terms And Conditions. The parties are independent to one another and are not related by franchise, partnership, employment, joint venture or otherwise. Our Site is not a party to any transaction between you and any third party advertisers or suppliers. You will look solely to the third party for all claims regarding their goods, services or information.

    Right To Rely On Instructions

    The Site may act in reliance upon any instruction, information, document, filing, name, e-mail address or user password that meets the Site's automated criteria or which is believed by the Site's personnel to be genuine. For any password protected areas, the Site may assume a person entering a user name (e-mail id) and associated password is, in fact, that user or is authorized by that user to act on his/her behalf. The Site may assume the latest e-mail ids and registration information on file with the Site are accurate and current. When programmed to do so, the Site may take prescribed actions in the absence of receiving proper and complete contrary instructions.

    Electronic Communications

    In the course of providing you the Service, Referralrecruitment will need to communicate with you through electronic forms of communication, including, without limitation, via posting, notices on the Site or sending you e-mail messages. By using the Site, you consent to receive communications from Referralrecruitment, and its third party partners and affiliates, in an electronic form; consent to have your name and/or e-mail id listed in the header of certain communications which you initiate through the Service, and agree that all agreements, statements, policies, notices, disclosures, and other communications that Referralrecruitment, or its third party partners and affiliates, provides to you electronically satisfy any legal communication requirements, including that such communications be in writing. These electronic communications may include notices about applicable fees, charges, rates, transactional information and other information concerning or related to the Site like jobs which we think you may be able to refer a Candidate or express interest in a job as a Candidate (including but not limited to any jobs within the industry areas in which you are already related on the Site). These electronic communications are part of your relationship with Referralrecruitment and you receive them as part of your registration on the Site.

    Performance And Maintenance Of Site

    You acknowledge that Referralrecruitment may perform maintenance on the Site as required from time to time, in Referralrecruitment's sole discretion. We may restrict access to some parts of the Site, or the entire Site, to users who have registered with us, during any maintenance periods.
    Notwithstanding the foregoing, Referralrecruitment is under no obligation to maintain the Site, or any features or functionality thereof, or make any changes or modifications to the Site requested by you. Referralrecruitment reserves the right, in its sole determination, to modify or eliminate any features or functionality of the Site at any time.

    Referralrecruitment is not responsible for maintaining the integrity and/or continuity of your content posted to the Site. You are responsible for keeping copies of your content to protect against loss of such content. Referralrecruitment will not backup or otherwise protect your content from loss or destruction.

    Changes To Site

    Referralrecruitment reserves the right to modify, change or discontinue the Site or any feature at any time without notice. You agree that the Site is not liable to you or to any third party as a result of any such action. We invite users to make suggestions for ways that the Site can be improved. If you make a suggestion, you authorize us to use the idea and to publish your name in connection with the submission. We do not pay compensation for using submissions.

    Suspension And Termination

    The Agreement is entered into for an indefinite term. Either party may terminate the Agreement in their sole discretion, at any time with or without cause and regardless of the stated registration period otherwise applicable. Protections afforded to us and to third parties by the Agreement will survive suspension or termination.
    Referralrecruitment does its utmost to ensure that the Site operates properly at all times, but we make no warranties as to the availability or accessibility of the Site, or any feature of the Site, and we reserve the right to alter any part of the Site at any time and to deactivate or cancel the Site at any time and for any reason.
    Save as otherwise set out in the Agreement. Referralrecruitment shall not be liable for any damages, loss, costs or expenses incurred by you as a result of any lack of availability or accessibility of the Site and any event beyond our reasonable control.
    If the Agreement is suspended or terminated as a result of unauthorized use or infringement of rights to content obtained from the system, you agree that upon request, you will destroy all copies of such content in your possession or under your control. During and after this suspension or termination all parties fully respect the Terms And Conditions for payments to all parties signed during the period of Agreement.

    Severability And Declaration Of Distance

    Each provision of the Terms And Conditions which excludes or limits liability, must be interpreted separately, it even applies if for any reason one or more of these provisions are considered as invalid or unenforceable in certain circumstances and will remain effective in spite of termination of the Terms And Conditions.
    Any provision of the Terms And Conditions found by a court to be illegal or unenforceable, shall automatically be deemed conformed to the minimum requirements of law and shall thereupon be given full force and effect as so modified, it shall not affect the validity of the Terms And Conditions, which shall remain valid and enforceable according to its terms.

    Not any declaration of distance of Referralrecruitment will be interpreted as a declaration of distance with respect to a preceding or next violation on any provision.
    No failure or delay by us in exercising our rights under the Terms And Conditions will be deemed to be a waiver of that right, and no waiver by us of any breach will be considered as a waiver of any subsequent breach.

    Confidential

    The Terms And Conditions and all the information made available by either of the parties hereto to the other party pursuant to the Terms And Conditions is and shall remain confidential and no such information shall be divulged to any third party without the prior consent of the other parties thereto (other than to the parties' respective professional advisors, persons involved in an actual or proposed joint venture, merger or acquisition of Referralrecruitment and any other person if required by law or its enforcement).
    The parties hereto shall make those of its directors, employees and consultants who have access to such information aware of the provision of this clause and shall procure the observance of the same by such directors, employees and consultants.
    The obligations contained in this article shall endure, even after the termination of the Terms And Conditions, without limit in point of time until such confidential information enters the public domain.

    Miscellaneous

    This document reflects our entire and exclusive agreement and supersedes all other agreements regarding this subject matter, whether written or verbal. Referralrecruitment reserves the right to assign the Terms And Conditions or delegate responsibility to any third party, including a party acquiring any of our operating assets or ownership interests. All licenses or permissions granted to you by the Terms And Conditions are personal in nature and may not be assigned, sublicensed or otherwise transferred and any attempt to the contrary is void.
    The section titles in the Terms And Conditions are for reference purposes only and have no legal or contractual effect.

    Amendments To These Terms

    Referralrecruitment reserves the right, in its sole discretion, to change the Terms And Conditions with or without notice, at any time. Any such change will be effective once reflected in the text of the Terms And Conditions and published on this web page. Referralrecruitment recommends that you check the Terms And Conditions periodically to ensure that you are aware of and complying with the current version as they are binding on you. By using the Site, you consent to the Terms and Conditions, whether or not you have reviewed such amendments.

    Governing Law And Jurisdiction

    THE TERMS AND CONDITIONS SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE SUBSTANTIVE LAWS OF THE NETHERLANDS (EUROPE)), WITHOUT REGARD TO CONFLICTS OF LAW PRINCIPLES. YOU AGREE TO INITIATE AND MAINTAIN ANY LEGAL ACTION IN SUCH DESIGNATED STATE/LOCALE AND IRREVOCABLY CONSENT TO EXCLUSIVE PERSONAL JURISDICTION AND VENUE THEREIN. YOU ARE RESPONSIBLE FOR COMPLYING WITH YOUR OWN LOCAL LAWS, WHICH MAY VARY WITH RESPECT TO CERTAIN ACTIVITIES OR PEOPLE (E.G., MINORS). YOU AGREE THAT DUTCH DISTRICT COURTS CAN HEAR CASES INVOLVING COPYRIGHT ISSUES BETWEEN US. SINCE REFERRALRECRUITMENT MAKES NO WARRANTIES AND HAVE LIMITED OUR LIABILITIES, YOU SHOULD HAVE LITTLE REASON TO HAVE GRIEVANCE WITH US.
    Should you nevertheless bring legal action against us, you irrevocably agree it will be brought and maintained on an individual basis (and not consolidated with similar cases) within half (1/2) year after the claim arises or be barred. As disincentive for unwarranted litigation, you agree that if you sue us and do not win on the merits, you will pay our defense costs, including reasonable legal fees for in-house and outside counsel. If Referralrecruitment is required to enforce the Terms And Conditions or our rights, you agree it is reasonable to send you legal notices and papers by electronic mail at your stated address (we would also attempt to send you a backup copy by regular mail).

    ALL THE PARTIES IRREVOCABLY AGREE THAT THE DUTCH COURT OF AMSTERDAM IN THE NETHERLANDS IS TO HAVE EXCLUSIVE JURISDICTION TO SETTLE ANY DISPUTE WHICH MAY ARISE OUT OF OR IN CONNECTION WITH THE TERMS AND CONDITIONS AND THE INFORMATION TO BE ENTERED INTO PURSUANT TO IT.
